1. INTRODUCTION

This Refund Policy governs refund requests relating to services provided by Global Mobility LLC ("Global Mobility", "CometoSpain", "Company", "we", "our", or "us").

By purchasing any service from CometoSpain, you acknowledge that you have read, understood, and accepted this Refund Policy.

This Refund Policy forms part of our Terms of Service.


2. APPLICABILITY

This Refund Policy applies to all customers worldwide.

Nothing in this Policy shall limit, waive, or exclude any mandatory consumer rights that may apply under the laws of a customer's country, state, province, or jurisdiction of residence. Where local consumer protection laws grant rights that cannot legally be waived, those rights shall prevail to the extent required by applicable law.


3. NATURE OF OUR SERVICES

CometoSpain primarily provides:

  1. Immigration consulting;
  2. Relocation services;
  3. Administrative support services;
  4. Eligibility assessments;
  5. Documentation assistance;
  6. Application preparation support;
  7. Digital information services;
  8. Educational and informational resources.

The Client acknowledges that many Services involve the allocation of professional time, expertise, strategic planning, case analysis, document review, administrative support, and case management.

Such Services may be considered partially or fully performed even where no government application has yet been submitted.


4. 14-DAY WITHDRAWAL RIGHT

Where applicable consumer protection laws provide a statutory withdrawal period, eligible consumers may withdraw from their purchase within fourteen (14) calendar days.

However, if the Client expressly requests that Services begin before the withdrawal period expires, the Client acknowledges that:

  1. Service delivery may begin immediately;
  2. Refunds may be reduced proportionally to Services already performed;
  3. Completed Services may become non-refundable to the extent permitted by law.

5. CONSULTATION SERVICES

Full Refund Eligibility

A consultation is eligible for a full refund only if:

  1. Cancellation is requested at least twenty-four (24) hours before the scheduled consultation time; and
  2. The consultation has not yet commenced.

Non-Refundable Consultations

Consultation fees are generally non-refundable where:

  1. The consultation has taken place;
  2. The consultation has started;
  3. The Client fails to attend;
  4. Cancellation occurs less than twenty-four (24) hours before the appointment.

Exceptions may be granted solely at the Company's discretion.


6. DIGITAL SERVICES AND INFORMATION PRODUCTS

Certain Services may include:

  1. Eligibility assessments;
  2. Immigration strategies;
  3. Relocation plans;
  4. Checklists;
  5. Guides;
  6. Templates;
  7. Educational materials;
  8. Digital content;
  9. Personalized recommendations.

Once delivered, accessed, downloaded, reviewed, or otherwise made available to the Client, such Services may become non-refundable to the fullest extent permitted by applicable law.


7. IMMIGRATION AND RELOCATION PACKAGES

Before Work Begins

A Client may be eligible for a refund if:

  1. No case manager has been assigned;
  2. No review of documentation has occurred;
  3. No consultation has been conducted;
  4. No strategic assessment has begun;
  5. No substantive work has been performed.

Approved refunds may be subject to payment processing costs and administrative expenses where legally permissible.


After Work Begins

Once work has commenced, any refund may be reduced to reflect:

  1. Professional consultation time;
  2. Case management;
  3. Administrative processing;
  4. Research activities;
  5. Document review;
  6. Translation coordination;
  7. Application preparation;
  8. Communication with authorities;
  9. Internal operational costs;
  10. Compliance reviews.

The Company reserves the right to retain fees corresponding to Services already performed.


8. GOVERNMENT DECISIONS

The Company does not control decisions made by:

  1. Immigration authorities;
  2. Government agencies;
  3. Consulates;
  4. Embassies;
  5. Tax authorities;
  6. Social security authorities;
  7. Administrative bodies.

Accordingly, refunds are not automatically available because:

  1. A visa is refused;
  2. A residence permit is refused;
  3. A citizenship application is denied;
  4. Processing times increase;
  5. Appointments become unavailable;
  6. Immigration laws change;
  7. Government policies change.

Government decisions do not constitute a failure of service by CometoSpain.


9. CONDITIONAL REFUND ELIGIBILITY FOLLOWING REFUSAL

Refund eligibility following an official refusal may be considered only where all of the following conditions are satisfied:

  1. The Client followed all written instructions provided by CometoSpain;
  2. All information supplied was accurate and complete;
  3. No material facts were omitted;
  4. No fraudulent documentation was submitted;
  5. No risk warning relating to the specific refusal ground had been provided;
  6. The refusal was not caused by circumstances outside the Company's control.

All determinations remain subject to case review by the Company.


10. CLIENT DECISIONS AGAINST PROFESSIONAL RECOMMENDATIONS

Where a Client elects to proceed contrary to written recommendations, warnings, or risk assessments provided by CometoSpain, any refund eligibility relating to the affected matter may be void.

The Company may require written acknowledgement of such decisions.


11. NON-REFUNDABLE COSTS

The following costs are generally non-refundable:

  1. Government fees;
  2. Embassy fees;
  3. Consular fees;
  4. Visa fees;
  5. Apostille fees;
  6. Translation fees;
  7. Notary fees;
  8. Courier expenses;
  9. Identity verification costs;
  10. Third-party service fees;
  11. Banking fees;
  12. Currency conversion fees;
  13. Stripe processing fees;
  14. Payment processor fees;
  15. Compliance screening costs;
  16. Chargeback administration costs.

These costs are incurred independently of application outcomes.


12. ABANDONED CASES

Where a Client becomes unresponsive for more than twelve (12) consecutive months, the Company may:

  1. Close the file;
  2. Archive the case;
  3. Terminate active work.

Refund rights may expire upon case closure.

Reactivation may require payment of additional fees.


13. FRAUD, MISREPRESENTATION, AND COMPLIANCE FAILURES

No refund shall be available where:

  1. Fraudulent information is provided;
  2. Documents are falsified;
  3. Material information is concealed;
  4. Identity verification cannot be completed;
  5. Anti-money laundering checks cannot be completed;
  6. Sanctions screening fails;
  7. Applicable laws are violated.

The Company may terminate Services immediately in such circumstances.


14. CHARGEBACKS AND PAYMENT DISPUTES

Clients agree not to initiate chargebacks for Services already rendered.

Where a payment dispute or chargeback is initiated, CometoSpain may provide:

  1. Contracts;
  2. Invoices;
  3. Work logs;
  4. Communications;
  5. Consultation records;
  6. Submitted documents;
  7. Service records;
  8. Internal case notes;
  9. Compliance records;

to payment processors, financial institutions, dispute-resolution providers, and legal authorities.

Fraudulent chargebacks may result in:

  1. Account termination;
  2. Collection proceedings;
  3. Legal action;
  4. Recovery of fees and costs.


15. MAXIMUM REFUND LIMITATION

Under no circumstances shall any refund exceed the amount actually paid by the Client for the specific Service giving rise to the refund request.

The Company shall not be liable for indirect, consequential, incidental, or special losses relating to refund claims.


16. REFUND REQUEST PROCEDURE

Refund requests must be submitted in writing and include:

  1. Full name;
  2. Email address;
  3. Order number (if available);
  4. Detailed explanation of the request;
  5. Supporting documentation where relevant.

17. REVIEW PROCESS

Upon receipt of a refund request, the Company may:

  1. Review the case;
  2. Request additional information;
  3. Assess work completed;
  4. Verify documentation;
  5. Evaluate contractual obligations.

A decision will typically be issued within fourteen (14) calendar days, although complex cases may require additional review time.


18. APPROVED REFUNDS

Where approved, refunds will generally be issued to the original payment method.

Refund processing times depend upon:

  1. Financial institutions;
  2. Card issuers;
  3. Banks;
  4. Payment processors.

The Company is not responsible for delays caused by such third parties.


19. FORCE MAJEURE

Refund obligations may be limited where delays, disruptions, or failures arise from circumstances beyond the Company's reasonable control, including:

  1. Government actions;
  2. Immigration policy changes;
  3. Legislative changes;
  4. Natural disasters;
  5. War;
  6. Terrorism;
  7. Cyberattacks;
  8. Labor disputes;
  9. Public health emergencies;
  10. Failures of third-party providers.


20. DISPUTE RESOLUTION

Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiations.

Where permitted by applicable law, disputes may subsequently be submitted to mediation or binding arbitration.

Nothing in this section shall restrict any mandatory rights available under applicable consumer protection laws.


21. CLASS ACTION WAIVER

To the fullest extent permitted by law, claims relating to refunds or Services shall be brought solely on an individual basis and not as part of any class action, collective action, representative proceeding, or similar mechanism.

Where such waivers are prohibited by applicable law, this provision shall apply only to the maximum extent permitted.


22. GOVERNING LAW

This Refund Policy shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Consumers shall continue to benefit from any mandatory consumer protection rights that cannot legally be waived under the laws of their jurisdiction of residence.


23. CHANGES TO THIS POLICY

We reserve the right to amend this Refund Policy at any time.

The most current version will be published on our Website and shall become effective upon publication unless otherwise stated.
